Marketplace Disclaimer

Version v1.0 · Effective date: October 12, 2026

Dragging Up is a listings and messaging marketplace. We do not employ anyone, we do not check anyone, and we do not guarantee anyone. Every Member decides for themselves who to work with, and carries the risk of that decision.

Who we are

Dragging Up is operated by Drill The Earth, LLC, a Texas limited liability company doing business as Dragging Up (the "Operator", "we", "us", or "our"). The "Service" means the Dragging Up website, apps and features. Capitalized terms not defined here, such as Member, Worker, Company, Crew and Listing, have the meanings in our Terms of Service. This disclaimer is part of the Terms of Service.

We are a marketplace only

The Service lets Workers, Companies and Crews post Listings, find each other and send messages. We do not take part in any job, bid, subcontract or deal between Members.

We are not:

  • the employer, joint employer or co-employer of any Worker;
  • a staffing agency, employment agency, placement service, recruiter, labor broker, labor contractor or professional employer organization;
  • a contractor, subcontractor or party to any bid, subcontract, job or agreement between Members;
  • a payroll provider, escrow agent, payment processor between Members, or guarantor of any wage, per diem, invoice or payment;
  • an insurer, bonding company, safety consultant or licensing authority; or
  • a background-check provider or consumer reporting agency.

We do not hire, refer, place, recommend, assign, supervise or direct any Worker or Crew. We do not set pay, rates, per diem, schedules or working conditions. We do not take a fee from anyone's wages or from the value of any job or bid.

No representations or warranties about Members or Listings

WE MAKE NO REPRESENTATION OR WARRANTY ABOUT ANY MEMBER, LISTING OR USER CONTENT. We do not represent or warrant that any Member is who they say they are, or that any Member:

  • holds the skills, experience, certifications, tickets, licenses, CDL or training they list;
  • carries the insurance, bonding or workers' compensation coverage they claim;
  • has a safe work record or a lawful business;
  • is authorized to work in the United States;
  • will pay the wages, per diem, rates or invoices they offer; or
  • will show up, finish the work, or perform it to any standard.

We do not represent or warrant that any job, crew availability, bid request, pay range, per diem, location, schedule or project described in a Listing is real, accurate, current, lawful or still available.

No duty to inspect, screen or verify

WE HAVE NO DUTY TO INSPECT, SCREEN, VERIFY, INVESTIGATE OR MONITOR ANY MEMBER, LISTING, MESSAGE, DOCUMENT, JOBSITE, PROJECT OR PAYMENT, AND WE DO NOT DO SO AS A ROUTINE.

  • We do not run background checks, criminal checks, drug tests, credit checks, license checks, insurance checks or reference checks.
  • We do not rate, score or rank Workers or Crews.
  • Profiles, résumés, certifications and Listings are written by the Members who post them. They are self-reported and are not consumer reports.
  • A badge, label or plan name on the Service means only what its description says, such as "email confirmed" or "Company plan". It never means that we vetted, approved, insured or recommend anyone.
  • We may review or remove content, or act on reports, when we choose to. Doing so in one case does not create a duty to do so in any other case.

What you must do yourself

Before you rely on another Member, you are responsible for your own due diligence. Depending on your role, that includes:

Workers

  • Confirm the company is real and is the actual employer: check its website, its state business registration and, where it applies, its contractor license.
  • Get the pay rate, per diem, travel pay, lodging, hours, overtime, start date and length of the job in writing before you travel.
  • Never pay a fee to apply or to be hired, and never send your Social Security number, bank details or ID images before you have a written job offer.

Companies and Crews

  • Verify identity, work authorization (Form I-9), qualifications, certifications, licenses, CDL and driving record, safety training and references through your own lawful hiring process.
  • If you use a background check, use a consumer reporting agency and follow the Fair Credit Reporting Act and state law.
  • Verify a Crew's or contractor's business registration, licenses, insurance certificates, bonding and safety record before you engage it, and put the deal in a written contract.
  • You alone decide whether a person is an employee or an independent contractor, and you alone are responsible for wages, overtime, payroll taxes, workers' compensation, OSHA compliance, utility-locate (811) requirements, permits and every other legal duty of an employer or contractor.

Jobsite, travel and safety risks

Utility, telecom and energy construction involves serious hazards, including without limitation excavation and trench collapse, underground utility strikes, energized lines, work at heights, heavy equipment, traffic, severe weather and long-distance travel. We do not control, inspect or supervise any jobsite, vehicle, lodging, equipment or work practice, and we do not provide safety training or advice. Each Member is responsible for the safety of its own work and people.

No professional advice

Content on the Service, including without limitation pay information, job descriptions, guides and help articles, is general information only. It is not legal, tax, employment, safety, insurance, immigration or financial advice. Consult a qualified professional before you make a decision with legal, financial or safety consequences.

Off-platform dealings

Any agreement, payment, travel, work or communication that happens outside the Service is solely between the Members involved. We have no role in it and no responsibility for it.

Third-party links and services

The Service may link to or rely on third-party websites and services. We do not control them and are not responsible for their content, accuracy or practices.

Assumption of risk and release

YOU CHOOSE WHETHER TO CONTACT, HIRE, ENGAGE, BID FOR, WORK FOR OR RELY ON ANY OTHER MEMBER, AND YOU ASSUME THE RISKS OF THOSE CHOICES. To the fullest extent permitted by law, you release the Operator and its members, managers, officers, employees, contractors, agents, affiliates, successors and assigns from claims arising out of the conduct of other Members and your dealings with them, on the terms of the "Release" and "Indemnity" sections of our Terms of Service, including the express statement there that the release covers claims arising from our negligence. The Terms of Service also limit our liability and require most disputes to be resolved by individual arbitration.

Nothing in this disclaimer limits any right you have that cannot be waived by law.

Report a problem

If you see a fake job, a scam, a request for a fee, a discriminatory post or unsafe conduct, use the Report button on the Listing, profile or message, or email legal@dragging-up.com. If you believe a crime has occurred or someone is in danger, contact law enforcement first.
